'No other option': DA announces officers in WTS Paradigm shooting will not face charge

MIDDLETON, wIS. - Dane County District Attorney Ismael Ozanne said officers will not face charges in fatally shooting a software worker who opened fire on his fellow employees in September.

Two Dane County sheriff's deputies and two Middleton police officers were in a shootout with 43-year-old Anthony Tong in WTS Paradigm's Middleton offices.

Ozanne said Tong gave law enforcement "no other option."

Tong was fatally shot. Three people were seriously wounded in the attack but survived.

Tong was described by a former co-worker as a quiet person who never smiled. His motive also remains a mystery.

According to an affidavit filed in 2004 in South Dakota, Tong's concealed-carry permit had been revoked following a mental health check by police in 2004.

All four officers had been on paid administrative leave while the state Division of Criminal Investigation investigated the incident.
