MADISON, Wis. - Fitchburg police are recommending a former Dane County deputy be charged with two counts of first-degree intentional homicide in the death of his wife and sister-in-law.

Police filed a probable cause affidavit with the Dane County District Attorney’s Office late Monday.

The court document details the 911 call and subsequent police response to Andy Steele’s home.

Kacee Tollefsbol called 911 to report that her brother-in-law, Steele, had shot her in the back just before 1 p.m. Friday, the document said. Police entered the home on Yarmouth Greenway Drive and found Tollefsbol with a gunshot wound.

According to the document, police then found Andy Steele's wife, Ashlee Steele, dead in the home.

Andy Steele was found with a 9mm handgun in the home, the document said. Tollefsbol told police she heard a second shot fired and believed Andy Steele had shot himself, but police said only two rounds were fired inside the home, and Steele did not suffer a gunshot wound.

A doctor at the Dane County Medical Examiner’s Office said Ashlee Steele was breathing at the time she was fatally shot in the head.

The document is the first step in formal charges by the District Attorney’s Office against Steele. Fitchburg police say Steele is still in a Milwaukee-area medical facility, but may be released in the next 24 hours.

Dane County DA Ismael Ozanne said a decision will be made Tuesday morning about the location for a possible bond hearing for former Dane County Deputy Andy Steele, now accused in a double homicide.

Ozanne said Steele, 39, had been located at a Milwaukee-area medical facility, but Ozanne was unsure of Steele's condition and whether his release to jail was imminent. The DA said discussions will take place Tuesday morning as to a location for a hearing, including the possibility of whether it would take place in the hospital where Steele has been treated.

Ozanne also reiterated he will not make a decision on whether his office will take the case until a referral is made by the Fitchburg Police Department, but he told News 3 that at this point, he is not seeing a conflict.

Steele recently retired from the Dane County Sheriff's Office after being diagnosed with ALS. He has been seen on TV taking part in the ice bucket challenge to raise money for the cause.
